1. About these terms

These Terms of Service (“Terms”) apply to your use of the Learnish Academy website and to the tutoring, educational consulting and career consulting services we provide (“Services”). By booking or using our Services, you agree to these Terms. If a student is under 18, the parent or guardian who books the Services agrees to these Terms on the student’s behalf.

2. Our services

We provide academic tutoring, university and college admissions consulting, and career consulting, online and in person in Brampton, Ontario. Descriptions on our website are a general guide; the specific services, schedule and price for your student will be confirmed in writing before you begin.

3. No guarantee of results

We do not guarantee any particular marks, grades, test scores, admission to any school or program, scholarships or career outcomes. Results depend on many factors outside our control, including the student’s effort and attendance, school assessments, and the independent decisions of universities, colleges, employers and award committees. Our role is to teach, guide, advise and support.

Admission requirements, deadlines and application processes are set by each institution and can change. While we work to give accurate guidance, families are responsible for confirming requirements and deadlines with each institution and for submitting applications on time.

4. Academic integrity

We help students learn; we do not complete graded work, tests or applications for them. Students are responsible for submitting their own work in line with their school’s and institutions’ policies. We may decline requests that would breach academic integrity.

5. Bookings and scheduling

  • Sessions are scheduled by mutual agreement and confirmed by email or text.
  • Please join online sessions on time with a working device, camera and microphone.
  • If a student is more than [CONFIRM 15] minutes late without notice, the session may be treated as missed.

6. Fees and payment

  • Prices are listed in Canadian dollars on our Pricing page or in your written quote. [CONFIRM] Applicable taxes (HST) are extra.
  • [CONFIRM] Packages and monthly plans are paid in advance. Single sessions are paid at the time of booking.
  • We accept [CONFIRM e-Transfer, credit card, debit].
  • We may change our prices with at least [CONFIRM 30] days’ notice; changes do not affect sessions already paid for.

7. Cancellations, rescheduling and refunds

  • [CONFIRM] You may cancel or reschedule a session at no charge with at least 24 hours’ notice.
  • [CONFIRM] Sessions cancelled with less than 24 hours’ notice, or missed, may be charged in full. We may make exceptions for emergencies.
  • If we need to cancel a session, we will reschedule it or credit/refund it.
  • [CONFIRM] Unused prepaid sessions may be refunded within [ADD NUMBER] days of purchase, less any sessions already used at the single-session rate.
  • Packages expire [CONFIRM e.g. 6 months] after purchase unless we agree otherwise.

8. Conduct and safety

We expect respectful behaviour from students, families and our team. We may pause or end Services if there is abusive behaviour, repeated non-payment or a safety concern. Parents and guardians are welcome to observe sessions. Sessions are not recorded without written permission from a parent or guardian.

9. Intellectual property

The content of our website and our teaching materials (including worksheets, guides, templates and presentations) belong to Learnish Academy or our licensors. You may use materials we provide for the student’s personal learning, but you may not copy, sell or distribute them without our written permission. Students own their own work, including personal statements and applications.

10. Website use

Information on our website, including blog articles, is general information only and is not professional, legal or financial advice. Please do not misuse the website — for example, by attempting to disrupt it or submitting false information through our forms.

11. Limitation of liability

To the extent permitted by law, Learnish Academy is not liable for any indirect, incidental or consequential loss, including loss arising from admission decisions, missed deadlines, marks or career outcomes. Our total liability for any claim related to our Services is limited to the amount you paid us for the Services in the [CONFIRM three] months before the claim. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

12. Privacy

Our Privacy Policy explains how we handle personal information.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. [VERIFY with your lawyer]

14. Changes and contact

We may update these Terms from time to time; the “last updated” date shows the latest version. Questions? Email info@learnish.ca.
